SALVAGE CONVENTION REVIEW/ENVIRONMENTAL SALVAGE

Action required:  Members’ are invited to note the attached final ICS Position paper on Environmental Salvage which has been expanded now to also include the ICS position on the proposal to revise the Salvage Convention such that in the case of containerships, shipowners become solely responsible for payment of cargo’s portion of salvage with a right of recourse against the party ultimately responsible.

Once I have the changes I can request ILO to help in this regard.

Action required: The ICS Secretariat attended a meeting at the USCG Headquarters in Washington D.C. to discuss the further development of the working draft ISO 13613 “Ships and marine technology – Critical systems for propulsion and manoeuvrability – Maintenance and testing guidelines” as advised by CE(09)21.   Members are invited to review and comment upon the report of the meeting and the revised draft now titled “Critical systems for propulsion – Important considerations” together with a draft paper developed for submission to the 14th session of the IMO Bulk Liquids and Gases Sub-Committee (BLG14) that are attached as annexes to the circular. All comments on this work are requested to be provided to the undersigned by the 28th October 2009 to enable additional input to this work.

PRESTIGE: MANGOURAS V SPAIN: EUROPEAN COURT OF HUMAN RIGHTS 

Action:  To note that the Master of the “Prestige”, Captain Mangouras, has been granted leave to appeal the European Court of Human Rights’ ruling that the level of bail set by the Spanish Courts following the oil pollution incident (Euros 3 million) was not disproportionate and that the Master's personal circumstances had been taken into account in fixing the amount.  Unless there are views to the contrary, ICS/ISF intend to participate with other industry associations in the appeal stage of the proceedings by filing written submissions in advance of the 17 July deadline.

CRIMINALISATION OF SEAFARERS: CROATIAN ROUND TABLE DECLARATION

Action required: To note the attached Declaration of the Round Table on Criminalisation of Seafarers, which was held in Zadar, Croatia, on 17 April.  Members are requested to inform their administrations of the conclusions of the Zadar meeting, including the need for shipping experts to be involved from the early stages of any criminal proceedings against seafarers, with a view to encouraging further action by IMO and/or ILO to ensure the fair treatment of seafarers.
