CHINA: REGULATIONS ON THE PREVENTION AND CONTROL OF MARINE POLLUTION FROM SHIPS

Action required: To note the attached P&I Club circular, which advises that it is the International Group’s understanding that the requirement for shipowners and operators to contract with a PRC Maritime Safety Agency approved pollution response company before entering a PRC port is not presently being enforced.  Publication of the list of MSA approved contractors is awaited and the IG understands that shipowners might have a further 3 months in which to comply with the requirement.

UK HIGH COURT CLARIFIES LEGALITY OF RANSOM PAYMENTS

Action required: Members attention is drawn to the recent findings of the UK High Court which clarified the legality of ransom payments.  Members may find this of particular benefit following on from concerns expressed that the UK and US government may be planning to outlaw ransom payments to Somali Pirates.

Action required:  Members are invited to note that the possibility that an attempt to ban ransom payments to Somali pirates appears to be gaining in credibility.  Information is requested from members on positions that may be taken by governments if this becomes a matter of debate within the UN.

Action: To note the report below of a government proposal for modest increases to shipowners’ limits of liability for damage caused by packaged HNS and to seek support for the proposal from Members’ respective governments.  To inform shipowner members, as soon as possible, of the proposal, and request them to bring it to the attention of Club Boards to ensure its widest possible support in preference to any other proposals that may be discussed.

EU DIRECTIVE 2005/33/EC – SAFETY CONCERNS WITH MARINE FUEL WITH LESS THAN 0.1% SULPHUR CONTENT AT BERTH IN EU COMMUNITY PORTS

Action required:  Members are invited to note the content of a letter to the EC on safety concerns with regard to low sulphur operation of boilers in EU ports.  Members are invited to bring the letter to the attention of their Administration.  Members are further invited to comment in principle on a proposed submission to the IMO Assembly and to ensure that shipping companies are aware of fuel switching training needs and other concerns.

REPORT ON GERMAN FSA PROJECT ON CONTAINER FIRES ON THE DECK OF CONTAINER SHIPS

Action required:  Members are invited to review the FSA “Container Fire on Deck”, attached as Annex to this circular, that has been performed on behalf of the German Administration. This FSA has been carried out consequent to the concerns raised by Germany relating to the availability of fire fighting water at the top of stacks of containers on the deck of large container ships that has resulted in the IMO FP Sub-Committee agenda item “Review of fire protection requirements for on-deck cargo areas”.  It is understood this FSA will be presented to FP 54 in April 2010 for information together with a recommended action paper that is yet to be developed.  Any comments on this work should be forwarded to the undersigned.

USA PROPOSED RULEMAKING ON BALLAST WATER DISCHARGE STANDARDS

Action required:  Members are invited to review and comment on the United States proposed rulemaking on treatment standards for the allowable concentrations of living organisms in ballast water and its proposed implementation schedule attached as Annex to this circular.  Members are requested to provide their comments to the undersigned by Wednesday 11th November 2009 to enable a suitable ICS position to be gained for comment on this rulemaking prior to the deadline of November 27th 2009.

Action required:  The ICS Secretariat attended a meeting at the USCG Headquarters in Washington D.C. to discuss the further development of the working draft ISO 13613 “Ships and marine technology – Critical systems for propulsion and manoeuvrability – Maintenance and testing guidelines” as advised by CE(09)21.   Members are invited to review and comment upon the report of the meeting and the revised draft now titled “Critical systems for propulsion – Important considerations” together with a draft paper developed for submission to the 14th session of the IMO Bulk Liquids and Gases Sub-Committee (BLG14) that are attached as annexes to the circular. All comments on this work are requested to be provided to the undersigned by the 28th October 2009 to enable additional input to this work.

PRESTIGE: MANGOURAS V SPAIN: EUROPEAN COURT OF HUMAN RIGHTS 

Action required:  To note that the Master of the “Prestige”, Captain Mangouras, has been granted leave to appeal the European Court of Human Rights’ ruling that the level of bail set by the Spanish Courts following the oil pollution incident (Euros 3 million) was not disproportionate and that the Master's personal circumstances had been taken into account in fixing the amount.  Unless there are views to the contrary, ICS/ISF intend to participate with other industry associations in the appeal stage of the proceedings by filing written submissions in advance of the 17 July deadline.
